Terms of Service.

1. What AlterSend does

AlterSend is operated by Devaprime LLC ("we", "us"). AlterSend lets you transfer files directly between two devices. All transfers are encrypted end-to-end. In most cases files travel directly between devices; if a direct connection isn't possible (for example, both devices are behind a VPN), encrypted data may pass through a relay server we operate. The relay is on by default and can be turned off in the app. Either way, we never have the ability to decrypt, store, or view the files you transfer.

2. Acceptable use

You may use AlterSend only for lawful purposes. You must not use AlterSend to transfer, receive, or distribute content that is illegal in your jurisdiction, including but not limited to child sexual abuse material (CSAM), content that glorifies violence or terrorism, or content that infringes third-party intellectual property rights. You must not send malware, ransomware, spyware, or any software designed to damage, monitor, or gain unauthorised access to another device. You must not harass, threaten, or abuse another person, or circumvent any applicable laws or regulations. These rules apply whether a transfer completes directly between devices or passes through our optional relay servers. We have zero tolerance for objectionable or abusive content and will take appropriate action, including blocking specific devices from using the relay, against users who violate these rules.

3. Reporting abusive content

If you receive content through AlterSend that you believe is illegal or violates these Terms, please report it immediately. In-app: use the "Report this content" link on the download-complete screen. By email: send a description to abuse@altersend.com. We review all reports and will act within 24 hours for reports of illegal content.

4. Your content and responsibility

You are solely responsible for the files you choose to send or receive using AlterSend. Because all transfers are end-to-end encrypted — whether direct or relayed — we cannot decrypt, screen, or moderate content in real time. You represent that you have the right to transfer any file you send, that the content you transfer complies with these Terms and applicable law, and that you will not use AlterSend to send content to someone who has not consented to receive it.

5. Open-source software

AlterSend is released under the Apache 2.0 license. The source code is available at github.com/denislupookov/altersend. Your use of the source code is governed by that license, not these Terms.

6. No warranty

AlterSend is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be error-free, uninterrupted, or that transfers will always complete successfully. Peer-to-peer networking inherently depends on network conditions outside our control.

7. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of AlterSend, including loss of data, loss of files, or damages arising from content transferred through the app. Our total liability to you for any claim shall not exceed the total amount you paid us in the twelve months before the claim, which is zero unless you hold an AlterSend Pro subscription.

8. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page. Continued use of AlterSend after changes are posted constitutes your acceptance of the new Terms.

9. Governing law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which AlterSend is operated. Any disputes shall be resolved in the competent courts of that jurisdiction.

10. AlterSend Pro subscriptions

AlterSend is free to use. AlterSend Pro is an optional paid subscription that raises the size limit on transfers routed through our relay servers and gives those transfers priority when a relay is busy. Direct peer-to-peer transfers remain unlimited for everyone. The following terms apply if you subscribe:

• Pro is offered on a monthly or yearly plan. The exact price for your plan and currency is shown in the app before you confirm, and that is the price you pay.
• Subscriptions renew automatically at the end of each period, at the then-current price, until you cancel. Your payment method is charged at the start of each renewal period.
• You can cancel at any time. For purchases made in the iOS app, use Settings → your name → Subscriptions on your device; for the Android app, use Subscriptions in the Google Play Store; for purchases made by card, use the “Manage subscription” button in the app, which opens the Stripe billing portal. Cancelling stops future renewals; your subscription stays active until the end of the period you have already paid for, and no partial refunds are given for the remainder of a period.
• Subscribing does not create an account. You receive a 16-digit code that is your subscription, and you enter it to activate Pro on your other devices. We store only a hash of it and therefore cannot recover it for you. If you lose the code and have no active device holding it, you may lose access to a subscription you have paid for. Keep it somewhere safe.
• Restoring a purchase on a device that no longer holds your code may issue you a replacement code and retire the previous one. When that happens the app shows you the new code, and the old one stops working immediately.
• Purchases made in the iOS or Android app are processed by Apple or Google, and refunds for those purchases are governed by their policies, not ours. For purchases made by card, contact hello@altersend.com. Nothing in these Terms limits any statutory refund or cancellation rights you have where you live.
• We may change the price of a subscription. Any change applies from your next renewal, and we will give you notice before it takes effect so that you can cancel if you do not want to continue.
• The relay size limits associated with each tier are described in the app and may change as we adjust capacity. We may suspend or refuse relay service for use that breaches Section 2, without refund.

11. Tips

By making a financial contribution (“tip”) to support the development or maintenance of the Software, you acknowledge and agree that:

• All tips are made voluntarily and without expectation of any goods, services, or other benefits in return. Tips do not constitute a purchase, investment, or any form of consideration for current or future services.
• All tips are final and non-refundable, regardless of whether the Software’s development continues, is modified, suspended, or discontinued.
• A tip does not grant you any ownership, intellectual property rights, or other legal interests in the Software, its source code, or related projects.
• Tips may be used at the sole discretion of the Company to support the development, maintenance, or related operational costs of the Software.
• Maintainers and/or the Company are under no obligation to act upon suggestions, requests, or expectations made by donors, unless explicitly agreed upon in writing.
